New Delhi, March 16 (UNI) A Delhi Special court on Saturday sent Bharat Rashtra Samithi (BRS) MLC K Kavitha to seven-day Enforcement Directorate custody in connection with the Excise policy case.
Special Judge MPs/MLAs cases M.K.Nagpal after hearing arguments on behalf of Counsel for ED and Defence Counsel passed an order sending her to ED custody till March 23.
Counsel for Kavitha opposed the ED custody by submitting that it is a fabricated case and all allegations levelled are illegal.
Kavitha, daughter of former Telangana Chief Minister K Chandrashekar Rao, was arrested by the ED on Friday after the law enforcement agency team raided her residence in Hyderabad.
She was produced before the court here this morning for obtaining her custody for interrogation in the Money Laundering case under the provisions of Prevention of Money Laundering Act (PMLA).
ED’s Special Counsel Zoheb Hossain and Special Public Prosecutor(SPP) Naveen Kumar Matta moved an application under section 167 of Criminal Procedure Code(Cr.P.C.) read with section 65 of Prevention of Money Laundering Act (PMLA) by seeking 10 days ED custody of Kalvakuntla Kavitha.
It is submitted on behalf of ED that an FIR was registered by CBI on 17.8.2022 against Manish Sisodia, former Delhi Deputy Chief Minister related to irregularities in framing and implementation of Excise policy of Delhi for the year 2021-22.
Government Counsel submitted that ED initiated investigation by registering ECIR on 22.8.22. ED has filed a prosecution complaint on 26.11.22 and Hon’ble Special PMLA Court took cognizance of offence.
ED seeks custody interrogation by submitting that arrestee is required to be interrogated in respect to unearth the remaining proceeds of crime.
Government Counsel further submitted that arrestee is required to be confronted with voluminous material which is possible in the custodial interrogation.
