New Delhi, July 30 (UNI) A Delhi Court on Tuesday adjourned the hearing on anticipatory bail application of probationary Indian Administrative Service officer Puja Khedkar till Wednesday in a cheating and forgery case registered against her.
Union Public Service Commission (UPSC) and Crime Branch, earlier, opposed the anticipatory bail application filed on behalf of Khedkar.
Additional Session Judge Devender Kumar Jangala allowed the UPSC to file objections to Khedkar’s bail application and also granted permission to advance arguments.
On receiving a complaint, Delhi Police’s Crime Branch registered a First Information Report against Khedkar for allegedly misusing the disability and Other Backward Class (non-creamy layer) quotas to secure her candidature in the civil services exam.
The UPSC had filed a complaint against Khedkar for allegedly fraudulently availing the civil services examination by faking her identity to take the examination.
In this matter, an application under Section 338 of Bharatiya Nagarik Suraksha Sanhita(BNSS), 2023 for allowing to file objection and assisting the Additional Public Prosecutor was moved, on behalf of the complainant on July 27.
Bharatiya Nagarik Suraksha Sanhita(BNSS)’s Section 338(2) lays down that if any private person instructs its advocate to prosecute any person in any court, the Public Prosecutor in charge of the case shall conduct the prosecution, and the advocate so instructed, shall act therein under the directions of the Public Prosecutor with the permission of the court.
The Court said, “Complainant wants to oppose the present bail application through private counsel, therefore, the permission of the court, to advance the arguments in the bail application is granted, to the counsel for the complainant. The complainant is also at liberty to file the ‘objections’, if any, on record during the proceedings of bail application.”
