Plea before SC to reduce time to file accounts of election expenses

6/21/2018

New Delhi, A petition has been filed before the Supreme Court seeking reduction of time period to file accounts of election expenses. This will, it contended, ensure that more time is available to analyse the accounts of contesting candidates. The petition filed by lawyer-cum-Bharatiya Janata Party leader, Ashwini Upadhyay, also sought the apex court's direction to the government of India to take appropriate steps to reduce the time period for filing of accounts of election expenses so that more time is available to analyse the accounts of contesting candidates as proposed by the ECI. Mr Upadhayay, in the petition, accessed by the UNI, sought that the Centre be asked to take appropriate steps to allow the filing of election petitions against the contesting candidate, who has lost the poll, but is guilty of corrupt practices under section 123 of the RPA (Representation of the People Act) as proposed by the Election Commission of India. It stated that the Central government should take appropriate steps due to the lacuna in existing laws related to election expenditure, long pendency of petitions and its ill effects on free and fair polls. Mr Upadhyay sought a direction to the Government of India to take appropriate steps to limit the election expenditure, made by a candidate when contesting from Local Authority, Graduate or Teacher constituency, as recommended by the ECI. The petition also sought a direction to the Government of India to take appropriate steps for appointment of additional Judges in the High Courts to decide the election petitions, preferably within six months and utmost within one year, as proposed by the poll watchdog.
