One of the Supreme Court Judges in a division bench, Justice L Nageswar Rao, on Monday recused, without citing any reason, from hearing the sexual assault case registered against the former Editor-in-Chief of Tehelka and senior Journalist, Tarun Tejpal.
Now the case will be heard by a new bench of the apex court.
"I am recusing from hearing the case," Justice Rao on Monday said.
The date has not been fixed by the top court yet, but it would be decided in a week or two as to which bench would hear the matter now.
According to the prosecution, Tejpal was accused of sexually assaulting a junior woman colleague (also a journalist) in a five-star hotel on November 7-8, 2013, during a Thinkfest event organised by Tehelka.
Tejpal was arrested by the police on November 30, 2013, in the case.
The trial was going on against Tejpal under various sections of the Indian Penal Code (IPC) including 376 (Rape) and 354 (Outraging the modesty of a woman).
He was charged by the trial court on February 18, 2014. If Tejpal, currently on bail, is convicted in the case, he will have to face a jail term of at least five years.
