New Delhi, Nov 5 (UNI) The Supreme Court on Tuesday deferred the plea by Samajwadi Party leader Mohd Abdullah Azam Khan Challenging the 2023 Allahabad High Court order refusing to stay his conviction in a 15 year old case leading to his disqualification as an MLA
Khan has pleaded that he was a juvenile when the offence happened and sought suspension of his conviction
Khan was convicted for offence during a Dharna staged along with his father. He was sentenced to 2 years imprisonment under Section 353 of the Indian Penal Code (IPC).
On September 26, the top court had directed the District Judge, Rampur to submit a report regarding the date of birth of Khan
A bench comprising Justice MM Sundresh and Justice Aravind Kumar took up the matter today.
Senior Advocate Kapil Sibal, appearing for Khan, said, ” Nothing is left here to explain. I have been declared juvenile in all the reports,”.
The Court posted the matter for Friday.
